Contract

Contract with a third-party based on unit price shall be signed when it is sole sourcing according to Article 25.

• Priority purchase of products developed by SMEs’ technologies
  • A policy that requires more than 10% of procurements made by public organizations to be quality products made with SMEs’ technologies with the goal to support SMEs’ sales and encourage continue R&D.
  • Legal basis : Clause 1, Item 14 of Act on Facilitating Purchase of SMEs’ Products and Support for Sales Channels and Article 13 of Enforcement Ordinance of the same Act
• Supply products developed with SMEs’ technologies to public organizations based on priority purchase and sole sourcing according to Act on Support for Sales Channels
  • Sole sourcing of products developed with SME technologies
  • Supply to public organizations as a priority by signing sole sourcing according to National Contracting Act and other related regulations

• Immunity from procurement loss incurred by procurement personnel
  • Personnel in charge of procurement in a public institution that has signed a contract to procure priority procurement product shall not be held accountable for any incurring loss unless evidence suggests deliberate or grave negligence.
